Another precise postponement in the Tax Reform package for NF-e and NFC-e
On October 1, 2026, the Federal Revenue Service, the IBS Management Committee, and ENCAT jointly published five technical notes updating the NF-e and NFC-e ecosystem for the Consumption Tax Reform. The documents were made available on the technical portal on October 1, 2026, in accordance with Joint Technical Act No. 8, of September 29, 2026. We have already discussed here the most visible changes in this package — net product value, exclusive IBS/CBS taxpayer, and the new DANFE layout. This post focuses on a point that went more unnoticed but directly affects multichannel retail: NT 2026.002, version 1.11.
What NT 2026.002 v1.11 changes
NT 2026.002, version 1.11, covers in-person and remote transactions with the possibility of printing the Simplified DANFE Type 2, and the novelty of this version is the postponement from October 5 to December 14, 2026 of the production start date for rules I08-180, BA02-35, and VC02-40. In practice, these validations deal with restrictions on the use of outbound NF-e that references NFC-e, CF-e, or NF-e with Simplified DANFE Type 2, according to the conditions and exceptions described in the technical note.
This is the rule that, in the day-to-day of POS and ERP systems, became known as the end of using CFOP 5.929 to consolidate fiscal receipts into a single NF-e. CFOP 5.929 remains available for other retail operational situations, but its historical use case of a monthly NF-e consolidating receipts changes shape, because referencing NFC-e within it becomes prohibited.
Attention: the postponement is partial, not total
This is the point that generates the most confusion among IT teams. The postponement covers these three rules, not all the issuance procedures provided for in the document. The core of NT 2026.002 remains valid as of October 5: the Simplified DANFE Type 2, the authorization of use with alert, and the new cStat and nProt numbering continue in production on October 5. As the market's technical analysis sums it up well, only the three referencing rules had their date changed, and reading the note as postponed in its entirety is the most likely mistake.
In short, those who already issue the Simplified DANFE Type 2 have gained no break at all. Those who use NF-e to reference NFC-e or a fiscal receipt (the logic of the old CFOP 5.929) have gained some breathing room: the three rules that reject outbound NF-e referencing a retail document go into production on December 14, 2026, and those who issue NF-e based on receipts or NFC-e gained ten weeks, and no exemption.
Context: why the Simplified DANFE Type 2 has already been postponed so many times
It's worth remembering the history to understand why this timeline is so unstable. The concept of the DANFE Type 2 emerged in April 2025, through SINIEF Adjustment 12/2025, and its effective date has already been postponed three times: November 2025, January 2026, and May 2026. The postponements reflect the complexity of the change, which involves a new layout, a new contingency flow, QR Code logic, and certification in the SEFAZ environments, and the final date became August 3, 2026. The postponement of the referencing rules to December follows this same logic: giving more certification time without halting retail operations.
What to check in your company's systems
- Map out the processes that currently use NF-e to consolidate fiscal receipts or NFC-e issued throughout the day or month (typical use of CFOP 5.929).
- Do not remove CFOP 5.929 from your ERP or POS table just because of this news: it appears in the current CONFAZ table and remains necessary for legitimate retail operations.
- Whenever possible, separate the retail operation (NFC-e) from the corporate operation (NF-e) from the source, to reduce reliance on cross-referencing before December.
- Confirm with your ERP/issuer provider whether rules I08-180, BA02-35, and VC02-40 are already mapped for production on 12/14/2026, and not on 10/5.
- Separately review whether your system is already compatible with the core of NT 2026.002 (Simplified DANFE Type 2 and authorization with alert), which has been in production since October 5.
This type of fine-tuned calendar adjustment tends to repeat in the coming months, as the Tax Reform timeline advances for NF-e, NFC-e, NFS-e, and other electronic fiscal documents. Maintaining a routine of monitoring ENCAT and Federal Revenue Service technical notes is now part of the job for any tax and IT team.
